The body meant to oversee mental health sat idle for years

Law 19.529 created an unpaid oversight commission. It lacked a full membership from September 2021, and only in June 2026 did the Health Ministry tell parliament it was operating again.

What it is

The 2017 Mental Health Act created the National Commission for Oversight of Mental Health Care, an unpaid body that must inspect inpatient facilities, receive the mandatory notifications of involuntary admissions and of stays beyond 45 days, and report irregularities. In July 2018 El Observador reported that the law, passed unanimously in August 2017, had been approved without resources: implementation was estimated at US$3 million plus some 100 million pesos for works at Vilardebó Hospital, and none of it made it into that year's budget review. Senator Marcos Otheguy said at the time: “It is an issue that concerns us and we want to address it”; Hugo Achúgar, of the federation of family organisations, said failing to fund it “is criminal” and called the US$3 million “a drop in the River Plate”.

What is questioned

The commission operated intermittently. On 14 March 2022 la diaria reported it had not functioned since September 2021, for lack of budget and because the renewal of its members was never completed: in late 2021 the ministry asked the scientific societies to pick a new chair, they agreed on a name and told the ministry, which did not respond again. Psychiatrist Ángel Valmaggia, a former chair, said in that article: “It is not trivial that the commission is not constituted, it is an extremely important role that is not being fulfilled: it is the guarantee for patients”. Only on 6 March 2026 did the Presidency appoint the commission's members by resolution and, that same month, the National Development Corporation opened call 57 —from 11 to 27 March 2026— to bring in “a minimum of 3 administrative secretarial contracts” and strengthen its administrative operation.

Why it matters to you

This is the body a person held against their will can turn to. Without a full membership and without administrative staff, that safeguard was weakened for years: nobody systematically checked whether an involuntary admission was justified, whether it ran longer than it should, or whether a facility met the conditions to keep someone admitted.

Where it stands

Under way

On 25 June 2026, before the special parliamentary committee monitoring Law 19.529, the Health Ministry said the oversight commission “began operating in June, after a period without a full membership”, la diaria reported. The new members were appointed by resolution on 6 March 2026 and the administrative staffing call closed on 27 March 2026. As of this file (August 2026) there is nothing newer about the body having a budget of its own.

The commission is unpaid and buys almost nothing: its real cost sits in ministry salaries and in administrative support contracts run through the National Development Corporation, which do not always appear in the state procurement search.
